Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and The Host Report, Inc. ("The Host Report," "we," "us," or "our") governing your access to and use of our Custom Map Generation Web Application (the "Service") hosted at app.thehostreport.com.

By accessing or using the Service, you expressly acknowledge and agree to these Terms. If you disagree with any part of these Terms, you must cease using the Service immediately.

1. Service Description

Our Service provides users customized maps based on provided property addresses and selected points of interest. Maps are generated using proprietary software integrating Google Maps Platform services. Each single custom map is currently offered for a one-time fee of $29 (the "Single Map Purchase"). We may also offer multi-map bundles or property packs that include multiple maps or map credits in a single transaction (collectively, "Property Packs"). Pricing for Property Packs is displayed at checkout and may differ from the Single Map Purchase price.

2. Google Maps Platform Compliance

2.1 Service Access

This application's map customization interface is freely accessible to the general public. Our fee applies only to the final map generation and download service, not to access or use of the underlying Google Maps Platform implementation, ensuring compliance with Google Maps Platform Terms of Service.

2.2 Google Maps Attribution

All maps generated through our service display Google Maps content with proper attribution as required by Google Maps Platform Terms of Service. Users may not remove, obscure, or alter Google's branding, logos, or legal notices from any generated maps.

2.3 Prohibited Uses of Maps Content

Maps provided are strictly for informational and planning purposes only. Users expressly agree not to:

  • Use maps for real-time navigation or autonomous vehicle control.
  • Conduct mass downloading or create bulk feeds of map content.
  • Create mapping datasets to build substitute or competing services.
  • Print more than 5,000 copies of any map for commercial sales purposes.

2.4 Commercial Service Compliance

Our fees are solely for custom map generation and related design services. Users are paying exclusively for these value-added services, not access to underlying Google Maps content, in compliance with Google Maps Platform Terms of Service.

2.5 Data Handling

We collect and process location data (such as property addresses and points of interest) solely for map generation. Address data is retained only as necessary for service delivery and account management, in compliance with Google Maps Platform Terms of Service and applicable privacy laws. By providing your email address, you consent to receive service-related communications and periodic updates from The Host Report. You may unsubscribe from non-essential communications at any time.

2.6 Required Disclosures

By using this Service, users agree to comply with Google's current Terms of Service, Google Maps Additional Terms of Service, and Google Privacy Policy, as may be updated by Google from time to time. Users must provide these same terms to any end-users of their purchased maps.

3. Ownership & Intellectual Property

3.1 Content Ownership

Upon successful payment, users gain ownership of the custom-generated map image. However, all underlying Google Maps data, imagery, and content remain exclusively subject to Google's intellectual property rights and Terms of Service.

3.2 Proprietary Software

All rights to the proprietary technology, software, processes, methods, and interfaces used for generating maps remain fully vested in The Host Report. Users are strictly prohibited from reverse engineering, modifying, copying, or attempting to replicate our proprietary map-generation technology.

4. User Rights & Restrictions

4.1 Personal/Business Use Only

Purchased maps are licensed strictly for the buyer's personal or internal business use. Users may NOT:

  • Resell maps to third parties.
  • Use maps as part of commercial mapping services.
  • Redistribute maps in any format competing with Google Maps.
  • Incorporate maps into products sold to third parties.

5. Payments & Refund Policy

This Refund Policy outlines the conditions under which refunds may be issued by The Host Report, Inc. ("The Host Report," "we," "us," or "our") in connection with the Custom Map Generation Web Application (the "Service") hosted at app.thehostreport.com.

By purchasing and using our Service, you acknowledge and agree to the terms described herein.

5.1 Payments

All payments are securely processed via Stripe. Users agree to pay the applicable fee upfront for each Single Map Purchase and/or Property Pack as displayed at checkout.

5.2 Conditions for Refunds

Refunds may be granted under the following circumstances:

5.2.1 Standard Refund Conditions (Single Map Purchases Only):

  • Non-Delivery: If you do not receive your purchased custom map due to technical issues or service disruptions on our end, you are eligible for a refund.
  • Technical Failures: If the generated map is demonstrably unusable due to a technical malfunction directly attributable to our software or systems, you may request a refund.

For clarity, the standard refund conditions in this Section 5.2.1 apply only to a Single Map Purchase (one map purchased in a single transaction). They do not apply to any Property Pack, multi-map purchase, or any transaction that includes more than one map or map credit.

5.2.2 Promotional Refund Policies (Single Map Purchases Only):

From time to time, The Host Report may offer enhanced refund guarantees, satisfaction guarantees, or other promotional refund policies that provide more generous refund terms than those outlined in Section 5.2.1. Such promotional policies:

  • Will be clearly communicated at the time of purchase
  • May include specific time limitations, eligibility requirements, or expiration dates
  • Take precedence over the standard refund conditions during the promotional period
  • Are offered at The Host Report's sole discretion and may be modified or discontinued at any time

When a promotional refund policy is in effect, customers who make a Single Map Purchase during the promotional period will be subject to the more favorable promotional terms rather than the standard refund conditions outlined in Section 5.2.1. Unless explicitly stated otherwise in the promotional terms, Property Packs and other multi-map purchases are excluded from promotional refund guarantees.

5.2.3 Refund Limitation

Each customer account is eligible for a maximum of one (1) approved refund under this Refund Policy, and only in connection with a Single Map Purchase. Once a refund has been granted, the customer will not be eligible for additional refunds on any other purchases, past or future, regardless of circumstances. This limitation applies across all standard and promotional refund policies to prevent abuse of the Service.

The maximum aggregate refund amount per customer account is strictly capped at the then-current Single Map Purchase price, which is currently USD $29, regardless of the number, type, or total value of purchases made by that customer. Under no circumstances will The Host Report issue refunds exceeding this cap.

For clarity, this limitation applies on a per-customer basis and is not reset or expanded by multiple transactions, orders, or accounts associated with the same individual or entity.

5.3 Non-Refundable Situations

Except where superseded by promotional refund policies as outlined in Section 5.2.2, The Host Report explicitly does NOT offer refunds under any other circumstances, including but not limited to:

  • Dissatisfaction with the appearance or content of the map.
  • Errors made by the user during data entry (e.g., incorrect addresses, points of interest).
  • User's change of mind after purchase.
  • Issues stemming from third-party services, such as Google Maps, Stripe, or Firebase.
  • Any purchase of Property Packs or other multi-map bundles (including but not limited to 5, 10, or 25 map packs, or any map credits associated with those packs).

5.4 Refund Request Process

To initiate a refund request under valid conditions outlined in Section 1, please contact us at socials@thehostreport.com within seven (7) days of purchase. Include your order details and a detailed description of the issue encountered. Requests submitted beyond this timeframe will not be considered.

We reserve the right to investigate the claim and determine eligibility for a refund based solely on our discretion and evidence provided.

5.5 Refund Processing

Upon approval of your refund request, we will process your refund using the original payment method via Stripe. Refunds may take up to ten (10) business days to appear on your original payment method, depending on your financial institution.

5.6 Policy Amendments

The Host Report reserves the unilateral right to modify this Refund Policy at any time. Continued use of the Service following any modification constitutes acceptance of the revised policy.

6. Account Security & User Obligations

Users must keep their login credentials secure and confidential. Users accept full responsibility for all activities under their account. The Host Report reserves the absolute right to terminate user accounts at its sole discretion, particularly in cases involving violations of these Terms or Google's Terms of Service.

7. Liability & Warranty Disclaimers

7.1 Map Accuracy Disclaimer

Maps and directions are provided strictly for planning purposes. Actual conditions may differ due to weather, construction, closures, or unforeseen circumstances. Users must exercise independent judgment when using map content.

7.2 No Navigation Warranty

Generated maps are not intended for real-time navigation and must not be relied upon as the sole source for travel decisions.

7.3 Limitation of Liability

To the fullest extent permitted by law, The Host Report's liability under any circumstances shall be strictly limited to the lesser of: (a) the total amount actually paid by the user for the specific transaction giving rise to the claim, or (b) USD $29 (the current Single Map Purchase price). The Host Report shall not be responsible for any indirect, consequential, incidental, punitive, or exemplary damages.

7.4 Third-Party Services

The Host Report explicitly disclaims any liability arising from third-party services including, but not limited to, Google Maps Platform, Stripe, Firebase, or any other third-party integrations.

8. Service Modifications & Termination Rights

8.1 Service Updates

The Host Report reserves the unilateral right to modify the Service to maintain compliance with Google's Terms of Service or for any operational or legal reason.

8.2 Termination for Violations

We reserve the absolute right to terminate user access and accounts at our discretion, especially for violations of these Terms or Google Maps Platform Terms of Service.

8.3 Service Availability

The Host Report makes no guarantee of uninterrupted service availability. We may experience downtime due to maintenance, third-party service interruptions (including Google Maps Platform), or technical issues. Users acknowledge that temporary service unavailability does not constitute grounds for refunds or damages.

9. Dispute Resolution & Jurisdiction

Any claim or controversy arising out of or related to these Terms or the Service shall be resolved exclusively through binding arbitration conducted under the Comprehensive Arbitration Rules and Procedures of JAMS. Arbitration shall take place in Dallas, Texas, and Texas law governs this Agreement. Users expressly waive any rights to participate in class-action suits.

10. Modification Notifications

These Terms may be revised periodically. Continued use of the Service after any modification constitutes acceptance of the revised Terms. Users are solely responsible for regularly reviewing the posted Terms on our website.
